We at Predata, Inc. (“Predata,” “we,” “us,” or “our”) have created this privacy policy (this “Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to the information collection and use practices of Predata in connection with our websites located at https://predataprod.wpengine.com/ and http://app.predata.com (collectively, the “Websites,” and each, a “Website”), and our proprietary analytical platform (“Platform”) which is made available to you through our Websites.

EEA Individuals (GDPR and Privacy Shield)

Natural persons located in the European Economic Area (“EEA”) should review the General Data Protection Regulation (“GDPR”) and Privacy Shield Notice here.

In addition, the Privacy Shield Notice should be reviewed if your personal information is transferred from the EEA or Switzerland to the US, pursuant to the E.U.-U.S. or Swiss-U.S. Privacy Shield.

Description of Users and Acceptance of Terms

This Privacy Policy applies to visitors to the Websites, who view only publicly-available content (“Visitors”), and subscribers and their end-users who have signed up to access and use our Platform (“Subscribers”).

By visiting and/or accessing our Website, Visitors and Subscribers are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use.

By signing up, accessing and/or using our Platform, each Subscriber agrees to the terms of this Privacy Policy and the applicable subscription agreement between the Subscriber and Predata (the “Subscription Agreement”). In the event of a conflict or inconsistency between this Privacy Policy and the Terms of Use, and the Subscription Agreement, the Subscription Agreement shall control.

Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in the Terms of Use.

The Information We Collect and How We Use It

In the course of operating the Websites, and the Platform Predata collects (and/or receives) the following types of information.

Contact Information

When you sign up to receive Predata Research, contact us using the “Contact Us” page, or sign up as a Subscriber, you will be asked to provide certain information which may include your name, e-mail address, job title, and company name, country, state/region and phone numbers (fax, cell and/or landline) (collectively, the “Contact Information”). The Contact Information is used to provide the requested information, services or support and to contact Subscribers and Visitors for purposes of direct marketing of our current and future services. You may opt-out of receiving direct marketing by sending us an email at research@predata.com.

Billing Information

In order to purchase a subscription from our Platform, you will be required to provide certain additional information which may include the name of your bank, a banking account number, bank routing number, credit card number, expiration date, billing zip code, activation code and/or similar information (“Billing Information”). Billing Information is collected and processed by our third-party payment processor operating as our agent (See, Onward Transfers to Third Parties). We do not directly obtain or process any Billing Information.

Location Services

We may also collect city-level location information (“location data”) voluntarily provided by users who access our Websites or Platform. We may use such location data to allow users to incorporate outages in their workflow depending on their time-zone and to market our current and future products and services.

From Cookies

Cookies are small packets of data that a website stores on your computer’s hard drive or mobile device to “remember” information about your visit. If you do not want us to place a cookie on your hard drive, you may be able to turn that feature off on your computer or mobile device. Please consult your Internet browser’s documentation for information on how to do this. However, if you decide not to accept cookies from us, some features of the Websites and the Platform may not function properly.

Third-Party Analytics Providers

We use one or more third–party analytics services (such as Google Analytics on the Website, and Mixpanel on the Website and Platform to evaluate your use of the Website and the Platform, as the case may be, compile reports on activity (based on their collection of IP addresses, Internet service provider, browser type, operating system and language, referring and exit pages and URLs, data and time, amount of time spent on particular pages, what sections of the Websites and the Platform you visit, number of links clicked, search terms and other similar usage data), and analyze performance metrics. These third parties use cookies and other technologies to help collect, analyze and provide us reports and/or data. By accessing and using the Website and the Platform, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. Please be advised that if you opt out of any service, you may not be able to use the full functionality of the Website and the Platform.

Third Party Data Service Providers

We may obtain personal information from third-parties in order to provide the insights and signals (“Signals”) available within our Platform. Any personal data provided by these third party data service providers will be used in accordance with this Privacy Policy.

Aggregate Data

In an ongoing effort to better understand our users and the Websites and the Platform, we might analyze your information in aggregate form to operate, maintain, manage, and improve one or all of them. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our services, the Websites and the Platform to current and prospective business partners and to other third parties for other lawful purposes.

Sharing with Third Parties

Like many businesses, we hire other companies to perform certain business-related services. We may disclose personal information to certain types of third party companies but only to the extent needed to enable them to provide such services. The types of companies that may receive personal information and their functions are: hosting services, technical assistance, database management/back-up services, payment processors, use analytics, marketing automation platforms and CRMs, and customer service. These other companies will have access to the personal information only as necessary to perform their functions and to the extent permitted by law. We may also disclose your personal information to any of our parent companies, affiliates, subsidiaries, joint ventures, or other companies under common control with us in order to support delivery, marketing and sale of our products and services.

Business Transfers

In the event of a merger, dissolution, reorganization or similar corporate event, or the sale of all or substantially all of our assets, we expect that the information that we have collected, including personal information, would be transferred to the surviving entity in a merger or the acquiring entity. All such transfers shall be subject to our commitments with respect to the privacy and confidentiality of such personal information as set forth in this Privacy Policy.

Disclosure to Public Authorities

Predata may be required to disclose personal information in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. We may also disclose personal information to other third parties when compelled to do so by government authorities or required by law or regulation including, but not limited to, in response to court orders and subpoenas. 

Opt-Out for Direct Marketing; Email Management

You may opt out at any time from the use of your personal information for direct marketing purposes, and/or the transfer of your personal information to third parties for direct marketing purposes by emailing the instructions to research@predata.com. Please allow us a reasonable time to process your request.

You may also manage your receipt of marketing and non-transactional communications by clicking on the “Unsubscribe” link located on the bottom of any Predata marketing email and following the instructions found on the page to which the link takes you. You cannot opt out of receiving transactional e-mails related to the Platform. Please allow us a reasonable time to process your request.

Personal Information Rights

Upon request to privacy@predata.com we will provide you with confirmation as to whether we are processing your personal data, and have the data communicated to you within a reasonable time. You have the right to access, correct, amend or delete your personal data where it is inaccurate or has been processed in violation of this Privacy Policy. We may require payment of a non-excessive fee to defray our expenses in this regard. Please allow us a reasonable time to respond to your inquiries and requests.

Retention of Personal Information

We will retain your personal information in a form that identifies you only for as long as it serves the purpose(s) for which it was initially collected as stated in this Privacy Policy, subsequently authorized, or as otherwise permitted by law.

How We Protect Your Information

Predata takes very seriously the security and privacy of the personal information that it collects pursuant to this Privacy Policy. Accordingly, we will implement reasonable and appropriate security measures to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in processing and the nature of such data, and comply with applicable laws and regulations.

Children

We do not knowingly collect personal information from children under the age of 13through the Websites. If you are under 13, please do not give us any personal information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide personal information without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us, please contact us at privacy@predata.com, and we will endeavor to delete that information from our databases.

Important Notice to All Non-US Residents

Our servers are located in the US. If you are located outside of the US, please be aware that any information provided to us, including personal information, will be transferred from your country of origin to the US. Except in the case of data transfers under the EU-US Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework, your decision to provide such data to us, or allow us to collect such data through our Websites, constitutes your consent to this data transfer.

California Privacy Rights

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. Do Not Track

Predata does not respond to “Do Not Track” settings or other related mechanisms at this time.

Links to External Websites

The Websites and the Platform may contain links to third-party websites (“External Sites”). Predata has no control over the privacy practices or the content of any such External Sites. As such, we are not responsible for the content or the privacy policies of such External Sites. You should check the applicable privacy policy and terms of use when visiting any such External Sites.

Changes to This Privacy Policy

This Privacy Policy is effective as of the ‘Last Updated’ date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time with or without notice to you. By visiting the Websites and/or accessing the Platform after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
